Welcome to Jhooma. These Terms of Service ("Terms") govern your access to and use of the Jhooma website, Android application, and any associated services (collectively, the "Service"). By creating an account or using Jhooma, you agree to be bound by these Terms.
1. The Service and Account Tiers
Jhooma provides a digital music streaming service featuring exclusive Nepali music and a local media player.
- Jhooma Free: Grants limited access to the Service, including 30-second audio previews of platform tracks, integration with your local device audio files, and ad-supported features.
- Jhooma Pro: A premium, paid tier that unlocks full track streaming, ad-free listening, offline downloads within the app, and advanced organization features (Queue and Folders).
- 7-Day Free Trial: New accounts automatically receive a 7-day trial of Jhooma Pro. Upon expiration, the account automatically reverts to Jhooma Free unless a Pro pass is purchased.
2. Subscriptions and Payments
Jhooma operates on a manual top-up model. We do not automatically charge your payment methods on a recurring basis.
- Purchasing a Pass: Users may purchase a Monthly Pro Pass (30 days) or a Yearly Pro Pass (365 days) using supported local payment gateways, including eSewa, Khalti, and ConnectIPS.
- Expiration: When your Pro pass expires, your account will revert to the Free tier, and access to premium features (including playback of offline downloads) will be locked until a new pass is purchased.
- No Refunds: All purchases of Pro passes are final and non-refundable, except where required by applicable law.
3. Intellectual Property and AI Content
All music available for streaming on Jhooma is uploaded exclusively by the platform administrators.
- Original Human Authorship: The original Nepali lyrics, musical arrangements, and human-edited elements of the tracks are the exclusive intellectual property of Jhooma and are protected under the Nepal Copyright Act, 2059 (2002).
- AI-Generated Audio: Jhooma utilizes advanced artificial intelligence tools to generate the raw audio and vocal performances. While the raw AI output may exist in the public domain, the specific combination of our original lyrics, human editing, and the final mastered track provided on this Service remains strictly under Jhooma's exclusive commercial distribution rights.
- License to Listen: Jhooma grants you a limited, non-exclusive, non-transferable license to stream and (for Pro users) temporarily download the content solely for personal, non-commercial listening within the Jhooma app.
4. Prohibited Conduct
To maintain the security and exclusivity of the platform, you agree not to:
- Rip, extract, record, or digitally copy the audio streams or offline downloads provided by Jhooma.
- Distribute, broadcast, or upload Jhooma's exclusive tracks to other platforms (such as YouTube, Spotify, or social media) without explicit written permission.
- Attempt to bypass, disable, or defeat any encryption or digital rights management (DRM) used to protect offline downloads in the Android app.
- Use the Service for any commercial purpose, including playing the music in public venues, without a commercial license from Jhooma.
5. Local Audio Player
The Jhooma Android app includes a feature to play MP3 files stored locally on your device. Jhooma does not upload, host, or claim any ownership over your personal local media files. You are solely responsible for ensuring you have the legal right to possess and play the local files on your device.
6. Service Modifications and Termination
- Modifications: Jhooma reserves the right to modify, suspend, or discontinue any part of the Service at any time, including changing subscription prices or removing specific tracks from the catalog.
- Termination: We may suspend or terminate your account without notice or refund if you are found to be violating these Terms, specifically regarding the unauthorized extraction or distribution of our audio content.
7. Disclaimers and Limitation of Liability
The Service is provided on an "as-is" and "as-available" basis. Jhooma makes no warranties regarding the uninterrupted availability of the platform. In no event shall Jhooma be liable for any indirect, incidental, or consequential damages arising from your use of the Service or the inability to access your account.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Nepal. Any disputes arising out of these Terms, including issues related to intellectual property and copyright infringement under the Copyright Act, 2059, shall be subject to the exclusive jurisdiction of the courts located in Kathmandu, Nepal.
